Ithaca landlord fined for over-renting apartment

A local landlord has been fined $38,500 after she was found guilty of over-occupancy of her Collegetown rental property.
Cheryl Beach, the owner and landlord of the property located at 403 Elmwood Avenue in Ithaca, was charged with violating the Ithaca City Code zoning law which limits property in a R2-a zone to no more than three unrelated individuals by renting to eight unrelated college students from June 2010 to June 2011.
After a three day trial in Ithaca City Court, Beach was found guilty of 154 counts of over-occupancy, one count for each day that the property was over-occupied.
Beach has until May 5 to pay the fine.
The case was prosecuted by Assistant City Attorney Robert Sarachan, and the defendant was represented by Reuben Ortenberg, a Rochester based attorney.
