No charges in 'unavoidable' crash that killed 11-year-old on bike

State Police say it appears charges will not be filed against the driver in a crash that killed an 11-year-old boy in Oneida County on Monday.

Troopers said Tuesday Elijah Dibble rode his bike into the path of a vehicle driven by 27-year-old Eric Hale of West Winfield, and the accident was unavoidable.

Monday, police said Dibble was leaving his driveway on a bicycle when he was hit by a car driving west on State Route 20 around 1:00 p.m.

Dibble was taken to St. Elizabeth's Medical Center in Utica with serious head injuries, and was later transferred to SUNY Upstate Medical Center via helicopter in critical condition.

He passed away in Upstate's Pediatric Intensive Care Unit at 5:35 p.m. from massive head and chest trauma.
