Just as an upstate New York congressman planned to announce his retirement comes the news that his wife was arrested for drunk driving.

According to our affiliate WNYT in Albany, 49-year-old Allison Lee was arrested around 9:43 p.m. Wednesday night. She is married to Rep. Maurice Hinchey, who announced his retirement on Thursday.

Albany police say Lee rear ended a car in downtown Albany and failed field sobriety and breathalyzer tests. The other driver was not hurt.

Lee is charged with DWI, driving with a suspended license and driving while using a mobile phone.

According to WNYT, there are multiple reports Lee was charged with DWI last May as well.

Hinchey represents New York's 22nd Congressional District, which covers all or part of eight counties and ranges from the Hudson River, through the Catskills, across the Southern Tier and up to the Finger Lakes. His district includes Binghamton, Ithaca, Middletown, Kingston, Newburgh and Poughkeepsie.

The 73-year-old is scheduled to announce Friday that he will not seek re-election this year.
