New Hartford police arrested a woman for driving while under the influence while her two-year old daughter was in the backseat.
Police responded to an accident on route 8 in the Village of New Hartford around 1:15 p.m. on Monday. Police said 26 year-old Kelly Sperling of Utica skidded off the road and hit an embankment while trying to turn onto Campion Road.
Police said further investigation revealed Sperling was intoxicated and her two-year old child was strapped into a child safety seat in the backseat of the car.
Sperling was arrested for driving while intoxicated. Police say she resisted arrest and fought the officer that attempted to handcuff her.
The child was taken to Child Protective Services and will remain in their custody until the child endangerment investigation is over.
Sperling faces charges of aggravated driving while intoxicated with a child in the car, driving while intoxicated, endangering the welfare of a child, resisting arrest, speed not reasonable and refusal to submit a breath test.
Sperling was arraigned in New Hartford Village Court and is staying in Oneida County Jail. She is set to appear in court on Wednesday.
